High Court Rules on Sarpanch Resignation Withdrawal

Background

In a significant ruling, the Bombay High Court addressed the case of Kalavati Rajendra Kokale , who challenged the Collector of Raigad's decision declaring a vacancy in her position as Sarpanch of Ainghar village. The central legal question was whether Kokale 's resignation, which she withdrew during a Gram Panchayat meeting, was validly accepted despite her retraction.

Arguments

Petitioner’s Argument

Kokale 's counsel argued that her resignation was not effective as she withdrew it during the verification meeting on March 15, 2024. They contended that once a resignation is withdrawn, it ceases to exist, and thus, no further action is required to prevent its acceptance. The petitioner cited previous judgments supporting the inherent right to withdraw a resignation before it takes effect.

Respondent’s Argument

The State's representative contended that Kokale 's resignation was validly accepted by the Chairman of the Panchayat Samiti, and that the statutory provisions did not allow for withdrawal once the resignation was placed before the Panchayat. They argued that the resignation automatically took effect after seven days unless a dispute was filed.

Court's Analysis and Reasoning

The court analyzed the statutory framework under the Maharashtra Village Panchayats Act, particularly Sections 29 and 34, which govern resignations. It noted that while the Act does not explicitly provide for the withdrawal of a resignation, previous judgments recognized an inherent right to do so before the resignation takes effect. The court emphasized that once Kokale withdrew her resignation during the meeting, it became non-existent, and the meeting should have been terminated immediately.

The court further reasoned that the Collector's conclusion that Kokale 's resignation had taken effect was erroneous, as it ignored the fact that her resignation was withdrawn before any acceptance could occur.

Decision

The Bombay High Court ruled in favor of Kokale , setting aside the Collector's order declaring a vacancy and the subsequent election of a new Sarpanch. The court declared that Kokale 's resignation had not taken effect, allowing her to continue in her role as Sarpanch. This decision reinforces the principle that a resignation can be withdrawn before it is formally accepted, ensuring the rights of elected officials in local governance.
