In a tragic case of homicide, the sole accused in S.C.No.514 of 2012 was convicted and sentenced for the offense punishable under Section 302 of the Indian Penal Code (IPC) for the murder of Salahudeen. The incident occurred on April 6, 2010, at around 7:15 PM, near St. Joseph L.P. School in Balaramapuram, Kerala.
The prosecution argued that the accused had a motive to kill the victim, Salahudeen, due to enmity over the victim's warning to the accused against urinating in public places, which was against the tenets of Islam. Eyewitness testimonies from PW1 and PW2 were crucial in establishing the accused's involvement in the crime, with PW2 specifically describing the accused stabbing the victim multiple times.
The defense, however, challenged the reliability of the eyewitness accounts, claiming that the evidence was unsustainable in law. The defense also raised concerns about the investigation and the recovery of the weapon used in the crime.
The court carefully examined the evidence presented by the prosecution, including the medical evidence and the testimony of the investigating officer. The court found that the eyewitness accounts of PW1 and PW2, though not without minor inconsistencies, were credible and corroborated the prosecution's case.
The court also noted that the motive for the crime, as established through the testimony of PW5, was a relevant factor in determining the accused's involvement.
The court upheld the conviction of the accused and the sentence of life imprisonment, concluding that the prosecution had established the accused's guilt beyond a reasonable doubt. The court emphasized the importance of sifting through the evidence to separate the truth from any exaggerations or inconsistencies, and ultimately found the residuary evidence sufficient to convict the accused.
