From Contempt to Reconciliation: Allahabad HC Grants Bail in 'Ganga Iftar' Row

In a significant development concerning the 'Ganga Iftar' controversy, the Allahabad High Court has granted bail to three individuals—Danish Saifi, Noor Islam, and Amir Kaifi—who were arrested for allegedly desecrating the River Ganges. The decision comes after the applicants submitted an unconditional apology to the court, expressing deep remorse for their actions which had sparked widespread public outcry and claims of hurting the religious sentiments of the Hindu community.

The Varanasi Boat Controversy The case originated in Varanasi following an Iftar party held on a boat in the River Ganges on March 17, 2026 . According to the FIR filed by the Bharatiya Janata Yuva Morcha , the accused were seen consuming non-vegetarian food in the sacred river and discarding the remains into the water. The initial complaint alleged that this act was a calculated move to promote a "jihadi mentality" and deliberately disrupt communal harmony. The accused were subsequently booked under several sections of the Bharatiya Nyaya Sanhita (BNS) , including those relating to the defiling of a place of worship, public nuisance, and extortion, along with Section 67 of the I.T. Act .

Arguments for and Against During the proceedings before Justice Rajiv Lochan Shukla, the applicants' counsel highlighted that the detainees had no prior criminal records and had been in custody since mid-March . The defense argued that the accusations of extortion were belated and lacked substance. Furthermore, they emphasized that the applicants were no longer required for custodial interrogation , urging the Court to maintain parity with co-accused who had already been granted bail in previous orders on May 15, 2026 .

Conversely, the State’s Additional Government Advocate (AGA) strongly opposed the plea, characterizing the incident as a "larger conspiracy" to undermine public harmony. The prosecution maintained that the act was not merely an isolated incident but a high-profile provocation intended to spark communal friction.

The "Heartfelt" Apology and Judicial Relief The turning point in the proceedings was the submission of a supplementary affidavit in which the applicants declared their respect for Hinduism and 'Maa Ganges'. The sworn document stated:

"प्रार्थी माँ गंगा व हिन्दू धर्म का हृदय से सम्मान करता है। उपरोक्त मुकदमें की घटना से आहत हुए समस्त हिन्दू समुदाय एवम अन्य सभी धर्मावलम्बियों जिनकी आस्था का क ेन्द्र बिंदु माँ गंगा है, उनसे करबद्ध क्षमा प्रार्थी है..."

(Translated: "The applicant heartfully respects Mother Ganges and the Hindu religion. I am deeply apologetic to the entire Hindu community and seekers of other faiths who are hurt by the incident in this case and for whom Mother Ganges is the center of faith..." )

Key Observations Justice Rajiv Lochan Shukla, in his observations, noted the sincerity of the gesture:

  • "The averments made in the aforesaid paragraph as well as the submissions of the learned counsel for the applicants show a genuine remorse for the action attributed to the applicants."
  • "The note of apology that appears in the supplementary affidavit and the submissions of the Learned Counsels, in the opinion of the Court, appear to be heartfelt."
  • "Taking into account the entire facts and circumstances of the case, the lack of criminal antecedents of the applicants, the period of detention already undergone and the apology expressed in the supplementary affidavits, prima facie , a case for bail is made out."

Impact of the Order The court’s order directs the release of the applicants upon furnishing personal bonds and two reliable sureties . The conditions of the bail are strict: the accused are prohibited from tampering with evidence, intimidating witnesses, or engaging in any conduct that threatens communal harmony.

By mandating that release orders be transmitted through the Bail Order Management System (BOMS), the High Court has ensured a streamlined process for the applicants' exit from custody. While this decision brings a temporary closure to the bail phase for these three individuals, the shadow of the ongoing trial remains, with the court clarifying that all observations made were limited to the context of the bail application and should not influence future proceedings on the merits of the case .

With this decision, all 14 individuals implicated in the 'Ganga Iftar' case have now been granted bail , marking a resolution to the initial phase of one of the more contentious religious sentiment cases witnessed in Varanasi this year.
