In a significant ruling for government contractors, the High Court of Andhra Pradesh has directed state authorities to settle outstanding dues owed to a local contractor, reinforcing the judiciary's stance that the state cannot arbitrarily withhold payments for successfully executed public projects.

The Backdrop of the Dispute

The petitioner, Bolla Kiran Kumar, a contractor based in Krishna District, had been engaged by the Irrigation and CAD Water Resources Department to undertake the "Restoration of Irrigation System for effective Water Regulation" regarding the Old Bhumicodu and Jonnapadu medium drains.

Despite the successful completion of the works and the formal acknowledgement of the debt, the petitioner found himself in a financial deadlock. With final bills amounting to Rs. 8,62,232 pending for months, the petitioner approached the High Court seeking a Writ of Mandamus, arguing that the state’s inaction was not only causing him heavy financial loss but was also a direct violation of his constitutional rights under Articles 14, 16, and 21.

Arguments and Judicial Scrutiny

Representing the state, the Assistant Government Pleader for Irrigation acknowledged the validity of the work executed. Recent instructions dated December 18, 2025, indicated that the department had begun the process of uploading the pending bill to the 'NIDHI' portal.

However, Justice V. Sujatha remained unimpressed by the delays. Citing consistent judicial precedent, the court reaffirmed that the withholding of payment for completed services is essentially "arbitrary and high-handed." The court drew upon established legal standards, including its own previous rulings in W.P.No.10038 of 2021 , which established that the state is legally obligated to clear contractual dues in a timely manner.

  • "This Court, in various orders... had taken the view that such non-payment of dues is arbitrary and that such dues need to be cleared by the respondents at the earliest."
  • "The petitioner contends that such non-payment of money is clearly arbitrary and high-handed requiring the interference of this Court."
  • "As far as interest component is concerned, if there is any subsisting clause in the agreement/work order envisaging payment of interest upon any amount which is due and payable, the same is binding upon both the parties."

Justice V. Sujatha disposed of the Writ Petition with a clear directive: the respondents must release the admitted amount of Rs. 8,62,232 to the petitioner within two months from the date of receipt of the court’s order.

Furthermore, the court clarified that if the original work agreement contains specific clauses regarding interest payments on delayed dues, those clauses remain enforceable. This ruling serves as a vital reminder that administrative procedures, such as portal uploads, do not supersede the state's contractual duty to pay for work performed. For contractors across Andhra Pradesh, this provides a clear pathway for recourse when legitimate payments are stalled by bureaucratic inertia.
