Case Law
Subject : Criminal Law - Investigative Procedures
A High Court in Uttar Pradesh has ordered a Central Bureau of Investigation (CBI) inquiry into the death of a medical student, following contradictory reports from two state investigating agencies. The case, which involves the unnatural death of the student on September 5th, 2017, highlights concerns about procedural inconsistencies in criminal investigations.
The petition, filed by the deceased student's father, initially led to the filing of a First Information Report (FIR) and a subsequent charge-sheet, implicating two individuals under Sections 306/201 of the Indian Penal Code, 1860 (IPC). However, the Crime Investigation Division (CBCID), another state investigating agency, later filed a closure report under Section 173(8) of the Code of Criminal Procedure, 1973. This created a significant discrepancy in the investigative findings.
The High Court noted the existence of other similar cases of unnatural deaths in the same district, further underscoring the need for a thorough and impartial investigation.
The judgment highlights the contradictory nature of the two reports: a charge-sheet accusing two individuals and a subsequent closure report. The court reasoned that this conflict, coupled with the sensitivity of the cases, warranted the intervention of the CBI. The court's order emphasizes the importance of ensuring a fair and comprehensive investigation to resolve the inconsistencies and ascertain the truth behind the student's death.
The order specifically directs the two investigating agencies to cooperate fully with the CBI in its investigation. Once the CBI investigation is complete, its findings will be submitted to the appropriate court.
The High Court's decision underscores the limitations of concurrent investigations leading to conflicting reports, especially in sensitive cases involving unnatural deaths. The transfer of the investigation to the CBI reflects the court's commitment to achieving a just resolution and holding those responsible accountable. The CBI's investigation will now be critical in determining the circumstances of the student's death and bringing a sense of closure to her family. The outcome of the CBI investigation will set a precedent for future cases involving contradictory investigative reports and underscore the importance of independent oversight in ensuring justice is served.
