The petitioners, an elderly couple, had made several fixed deposits with the fifth respondent, a cooperative bank. When the deposits matured, the bank refused to pay the proceeds to the petitioners, despite their urgent need for the funds to cover medical expenses and personal obligations.
The petitioners argued that the bank's refusal to release the funds was illegal and uncharitable, as they were both suffering from various health issues and the second petitioner was also caring for her disabled husband and preparing for her daughter's marriage. The petitioners' counsel, Sri. Susanth Shaji, emphasized the dire financial situation of the elderly couple and the need for the court to intervene.
The court noted that the respondents 5 and 6 (the bank) had been properly served with summons but chose not to appear or provide any opposition to the petitioners' claims. The court also acknowledged the submissions made by the learned Senior Government Pleader, Smt. C.S. Sheeja, representing the official respondents, who stated that they were committed to ensuring the petitioners received their money at the earliest, but that it was ultimately the bank's responsibility to honor the payments.
The court allowed the writ petition and directed the fifth and sixth respondents (the bank) to ensure that the proceeds of the petitioners' fixed deposits, along with the accrued interest, were released to them within two months of receiving a copy of the judgment. The court also granted the petitioners the liberty to approach the court again for further relief, including under the Contempt of Courts Act, if the bank failed to comply with the order. The court left all other contentions open for the petitioners to pursue with the competent authorities as per the law.
