The Enquiry Commissioner and Special Judge, Thrissur, had ordered a preliminary verification of the complaint, which led to unwarranted observations against an IAS officer,
The respondent, the former Deputy Collector, claimed that he was entitled to promotion after the disciplinary proceedings against him were closed. He alleged that the then Chief Secretary, V.P. Joy, and officials in the General Administration Department had conspired to withhold his promotion file for over a year, demanding illegal gratification from him.
The Special Government Pleader, on the other hand, argued that the respondent had a history of facing disciplinary proceedings and that his promotion proposals were not recommended by the selection committees due to pending disciplinary actions and integrity concerns. The government also submitted that the promotion proposal was under examination and that the UPSC accepts only complete proposals.
