In a case challenging the appointment of a teacher to a Sociology position at a higher secondary school, the Kerala High Court has upheld the government's decision to approve the appointment despite the teacher not possessing the required B.Ed. degree in Sociology.
The petitioner, who had a B.Ed. degree in Social Science, argued that she was better qualified for the Sociology teaching position than the appointed candidate, who had a B.Ed. degree in Natural Science. The petitioner claimed that her Social Science degree should be considered equivalent to a Sociology degree under the relevant regulations.
The appointed teacher, the 7th respondent, defended her appointment, arguing that the regulations allowed for the consideration of candidates with B.Ed. degrees in any subject in the absence of those with the specialized degree.
The court noted that the regulations did indeed allow for the consideration of candidates with B.Ed. degrees in any subject if there were no applicants with the specialized degree in Sociology or a related subject. The court found that the petitioner had failed to provide any evidence to prove that her Social Science degree was equivalent to a Sociology degree and part of the same faculty.
Without such proof, the court agreed with the government's decision to consider all the candidates, including the 7th respondent, in the same category of those with B.Ed. degrees in any subject. The court found that the 7th respondent's ranking and selection were in accordance with the regulations.
The Kerala High Court dismissed the petitioner's challenge, upholding the government's approval of the 7th respondent's appointment as a Sociology teacher despite the lack of a specialized degree. The court also rejected the separate challenge to the educational qualifications prescribed for the position, finding that the petitioner was not entitled to do so after participating in the selection process.
