# Court Upholds Maintenance Order for Elderly Father, Dismisses Daughter's Petition
The case involves a dispute over the maintenance of an elderly father, the 2nd respondent, by his children. The petitioner, the elder daughter of the 2nd respondent, challenged the order passed by the Maintenance Tribunal directing her to pay a monthly maintenance of ₹10,000 to her father.
The petitioner argued that the Tribunal's order was not in compliance with the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 , as it did not implead the other two children, respondents 3 and 4, as additional respondents. The petitioner claimed that she had been regularly making online and offline money transfers to her father, and that the other two children were also gainfully employed and should share the responsibility of maintaining their father.
The court noted that the 2nd respondent had stated in his complaint that his second daughter (the petitioner) was employed and could help him financially, while the other two children were not in a sound financial position to do so. The Tribunal had also found that the payments made by the petitioner were insufficient for the 2nd respondent's decent living and medical expenses.
The court held that the Tribunal's order was not illegal, as it had considered the facts of the case and the 2nd respondent's financial and medical needs. The court also noted that the Tribunal had directed the other two children to bear the medical expenses of the 2nd respondent and his wife and to provide other necessary assistance.
The court dismissed the petitioner's writ petition, upholding the Maintenance Tribunal's order directing the petitioner to pay a monthly maintenance of ₹10,000 to her elderly father, the 2nd respondent.
