In a significant development for the legal fraternity in the capital, the High Court of Delhi has intervened to ensure that the legislative process remains inclusive. In a move highlighting the importance of stakeholder consultation, Hon’ble Mr. Justice Sachin Datta has directed the Government of National Capital Territory of Delhi (GNCTD) to provide the Coordination Committee of All District Courts Bar Associations with the finalized draft of the Advocate Protection Bill, 2024 .
The order serves as a reminder that major legislative policy decisions—specifically those impacting the rights and safety of legal practitioners—ought to be formulated with the benefit of input from the very community they aim to protect.
The matter, stemming from W.P.(C) 4555/2023, reflects the ongoing efforts by various bar associations to seek statutory protection for advocates in Delhi. The Coordination Committee, acting as the applicant in this instance, had been advocating for the review of the draft bill.
The core of the dispute was a procedural hurdle: despite the Law Department of the GNCTD having prepared a final draft of the Advocate Protection Bill, 2024 , this document remained inaccessible to the primary stakeholders—the advocates themselves. The Committee sought the document to ensure they could offer formal representations regarding its provisions before the bill progresses to the Council of Ministers for a final policy decision.
During the proceedings, the court acknowledged that while the enactment of the bill is a prerogative of the policy-making arm of the government, transparency is essential when drafting legislation that directly concerns professional welfare. The court weighed the request for disclosure as a reasonable and necessary step to ensure that the bar associations are heard.
