The CIC examined the arguments presented by both parties and emphasized the importance of balancing transparency with the protection of sensitive information. The Commission noted that the information requested pertained to purchase orders that could reveal detailed specifications and project details, which if disclosed, might jeopardize national security interests and the competitive position of BEL and its partners. The CIC referenced prior judgments that supported the non-disclosure of commercially sensitive information unless a larger public interest warranted it.
The Commission ultimately sided with BEL, ruling that the information sought was exempt from disclosure under the RTI Act. The CIC underscored that the appellant failed to demonstrate any substantial public interest that would necessitate the release of such sensitive information. Consequently, the appeals were dismissed, reinforcing the notion that certain information must remain confidential to safeguard national interests.
This decision underscores the delicate balance between the public's right to information and the need to protect sensitive data related to national security and commercial operations.
