Madras High Court Rules Against Land Acquisition Notification Published in District Gazette

The Madurai Bench of the Madras High Court, in a recent judgment delivered on January 30, 2025, ruled that the publication of a land acquisition notification in a District Gazette does not satisfy the requirements of Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (2013 Act). This significant ruling impacts land acquisition proceedings across Tamil Nadu.

Case Overview

The case involved two connected matters: a writ appeal (W.A.(MD) No.1683 of 2023) and a writ petition (W.P.(MD) No.329 of 2024). Both concerned the acquisition of land for the Thamirabarani – Kurumeniyaru – Nambiyaru Link Project, aimed at improving irrigation and drinking water access in Tirunelveli and Thoothukudi districts. The appellant/petitioner, P. Ganeshan (W.A.(MD) No.1683 of 2023) and T. Arasuraja alias Anburaja (W.P.(MD) No.329 of 2024), challenged the land acquisition proceedings initiated by the District Collector, arguing that the preliminary notification published in the Thoothukudi District Gazette was invalid.

The Hon'ble Mr. Justice R. Suresh Kumar and the Hon'ble Mr. Justice G. Arul Murugan constituted the bench.

Key Arguments

The petitioners argued that the notification, published in the District Gazette, failed to comply with Section 11(1)(a) of the 2013 Act, which mandates publication in the "Official Gazette." They cited a previous Division Bench judgment, Thirumani Dharmaraj v. The State of Tamil Nadu , which held that the District Gazette is not a sufficient substitute for the State Gazette.

The respondents countered that the District Collector, empowered as the "Appropriate Government" under Section 3(e) of the Act, was authorized to publish the notification in the District Gazette. They argued that the Thirumani Dharmaraj case overlooked relevant provisions of the General Clauses Act, 1897.

Court's Reasoning and Decision

The Court extensively analyzed the relevant sections of the 2013 Act, including Section 3(v) which defines "notification" as one published in the State Gazette, and Section 11(1)(a). The judges emphasized that the 2013 Act's clear language leaves no room for interpretation. The Court also referred to Rule 13(3) of the Tamil Nadu Right to Fair Compensation and Transparency in the Land Acquisition, Rehabilitation and Resettlement Rules, 2017, which explicitly mandates publication in the Tamil Nadu Government Gazette (State Gazette). The Court found the respondents' argument regarding the General Clauses Act unpersuasive.

Crucially, the Court extracted the following from the Thirumani Dharmaraj judgment: "The legislation is very carefully drafted. It only incorporates a deeming proviso...The Parliament must be deemed to be aware of the effect of usage of the term “Official Gazette” in Section 11 of the 2013 Act."

The Court ultimately agreed with the Thirumani Dharmaraj decision, holding that the notification published in the District Gazette was invalid. The writ appeal and writ petition were allowed, and the notification was quashed.

Implications

This judgment clarifies the legal requirement for publishing land acquisition notifications under the 2013 Act. It emphasizes the importance of strict adherence to statutory procedures, particularly when dealing with fundamental rights such as the right to property. While the Court acknowledged the laudable goals of the project, it underscored the necessity of complying with the law. The Court also directed the respondents to initiate fresh acquisition proceedings, complying with the 2013 Act within 4 months.
