2004 Supreme(SC) 590

B.P.SINGH, N.S.HEGDE
State Of W. B. – Appellant
Versus
Sadan K. Bormal – Respondent

Judgement Key Points

Certainly. Based on the provided legal document, here are the key points:

  1. The West Bengal Amendment Act of 1994 inserted Section 26A into the Prevention of Corruption Act, 1988, which created a legal fiction deeming judges appointed under the West Bengal Criminal Law Amendment (Special Courts) Act, 1949, as being appointed under the Prevention of Corruption Act, 1988 (!) (!) .

  2. This amendment authorized such judges to continue handling proceedings pending before them at the time of the amendment, as if they were appointed under the Prevention of Corruption Act, 1988, and validated all actions taken by them under the Act (!) (!) (!) (!) .

  3. The purpose of the amendment was to address the lacuna caused by the non-appointment of specific Special Judges under the Prevention of Corruption Act, 1988, after its commencement, thereby ensuring continuity and validity of ongoing proceedings (!) (!) .

  4. The amendment's legal fiction effectively extended the jurisdiction of judges appointed under the earlier West Bengal legislation to cases under the Prevention of Corruption Act, 1988, as if they were appointed under the latter Act from the outset (!) (!) (!) .

  5. Actions and proceedings taken by such judges prior to the amendment were deemed valid, as if the amended provisions were in force at the time, thus preventing procedural lapses or invalidations due to jurisdictional issues (!) (!) (!) .

  6. The Court emphasized that the purpose of the fiction was to ensure legal continuity and to avoid miscarriage of justice arising from the legislative gap, and that the fiction should be interpreted within its intended scope—covering actions taken during the relevant period (!) (!) .

  7. The Court also noted that the amendment did not create multiple or conflicting fictions, but rather a single, purpose-driven legal fiction designed to legitimize actions under the Act (!) (!) .

  8. Ultimately, the Court held that the high court's earlier judgment was per incuriam due to the oversight of the West Bengal Amendment Act, 1994, and accordingly, the appeal was allowed, directing the lower court to proceed with the trial in accordance with law (!) .

In substance, it held that though the said court was earlier empowered to try offences under the Act of 1947, since no such jurisdiction was conferred upon it afresh after coming into force of the Act of 1988, which repealed the Act of 1947, it had no jurisdiction to try such offences after coming into force of the Act of 1988.

2. The facts of the case which are not in dispute may be briefly recapitulated. The respondents herein were employees of the State Bank of India and a
