(1) WE have perused the office report dated 21/2/2001 and find that pursuant to our order dated 12/1/2001, an affidavit has been filed only on behalf of the Union Territory of Pondicherry in Criminal Misc. Petition No. 480/2001. None of the other States and Union Territories have filed their response to the suggestions made in Cri. Misc. Petition No. 480/2001. Even the Union of India has not filed its response so far.
(2) LEARNED counsel appearing for various States and Union Territories as also for the Union of India submit that within four weeks they will file the response and precisely indicate the steps which the concerned State/ Union Territory are taking to ensure compliance with all the directions given in D. K. Basu v. State of West Bengal (1997) 1 SCC 416: (1997 AIR SCW 233: AIR 1997 SC 610 : 1997 Cri LJ 743) in letter and spirit as well as to prevent custodial violence. They will also respond to the suggestions made in Cri. Misc. Petition No. 480/2001. We grant them time to do the needful as prayed for.
(3) LIST the matter after five weeks on a date to be fixed in consultation with the learned Amicus Curiae.
