Acceptance of explanation for non-compliance with court orders and direction for further steps to ensure compliance and execution of pending warrants

( 1 ) THE presence of Smt. Harpreet Kaur w/o Shri Prabhjot Singh is dispensed with for the present. An affidavit dated 16/4/1999 has been filed by the Commissioner of Police explaining the reasons as to why the earlier order of this court dated 15/3/1999 could not be complied with. We accept the explanation. We also notice that an enquiry has been initiated into the circumstances in which the earlier order of this court dated 15/3/1999 was not complied with. After the said enquiry is over, the result of the enquiry will be placed before the court.

( 2 ) IT has also been mentioned that so far as the subsequent order of this court dated 5/4/1999 is concerned efforts made so far have not resulted in the arrest of Shri Prabhjot singh. The affidavit gives a list of court cases in which Shri Prabhjot Singh is wanted and annexure b to the affidavit referred in para gives a further list of 10 cases in which shri Prabhjot Singh is involved where either investigation is pending or trial is pending. The Commissioner of Police will take further steps not only to have our order dated 5/4/1999 complied with but also take steps to see that any pending warrants issued in the various cases are executed as expeditiously as possible. A further report of the result of the investigation by the Police shall be placed before this court on 3/5/1999.

( 3 ) IN case Shri Prabhjot Singh is arrested before the next date of hearing pursuant to orders passed by this court in the contempt jurisdiction, he shall be produced in this court so that this court can pass further order in the matter. List on 3/5/1999.

( 4 ) THE I. A. filed by MR. SK Kulkarni, advocate on behalf of the L. Rs. of Ratnakar shall also be listed on 3/5/1999 along with the matters.
