(3) ON the relevant date the appellant was posted as a Chowkidar in the Court Complex at Barnala, in District Sangrur. On June 14, 1996, the learned Additional Civil Judge (Senior Division) and the learned Additional Civil Judge (Junior Division) made a surprise visit to the Court on - about 7.30 p.m. It was found, among other facts, that the appellant was not on duty. On that charge an enquiry was conducted against the appellant. He was found guilty of the charge by the Enquiry Officer. The Disciplinary Authority accepted the report of Enquiry Officer and dismissed the appellant from service. On appeal to the High Court (on the Administrative Side), the punishment of dismissal of the appellant was confirmed by order dated 1.2.2000. Against that order the appellant filed Civil Writ Petition No. 9433 of 2000 in the High Court of Punjab and Haryana at Chandigarh. A Division Bench of the High Court, by order dated July 27, 2000, upheld the order of punishment awarded to the appellant as confirmed by the High Court on appeal on the administrative side.
