Civil Procedure Code, 1908, Section 25 - Matrimonial dispute - Transfer of - Petitioner wife sought transfer of proceedings from Family Court at Chennai (T.N) to Family Court at Warangal (A.P.)- The Petitioner was a lady who is unemployed and has no source of income.-She also had no other male member to accompany her to Chennai-In any case the Respondent has to come from U.K. To India and therefore it makes no difference to him whether he goes to Chennai or to Andhra Pradesh-Therefore Divorce Petition transferred from the Family Court at Chennai, Tamil Nadu to Court of the Family Judge at Warangal District, Andhra Pradesh. ORDER
1. Heard parties.
2. This is the wifes petition for transfer of Divorce Petition OP No. 844 of 2004 titled Srikanth (Dr.) v. B. Neelima Rani Palakonda from the Family Court at Chennai, Tamil Nadu to the Court of the Family Judge at Warangal District, Andhra Pradesh.
3. The petitioner is a lady who is unemployed and has no source of income. She also has no other male member to accompany her to Chennai. In any case the respondent has to come from UK to India and therefore it makes no difference to him whether he goes to Chennai or to Andhra Pradesh.
4. We, therefore, deem it fit and proper to transfer the case. We accordingly direct that Divorce Petition OP No. 844 of 2004 be transferred from the Family Court at Chennai, Tamil Nadu to the Court of the Family Judge at Warangal District, Andhra Pradesh.
5. The transfer petition is allowed accordingly.
