UMESH J. PRASAD – Respondent


( 1 ) THIS is a transfer petition filed by the parents of the deceased wife seeking transfer of guardianship proceedings filed by the respondent, the husband of their deceased daughter, against them in the Court of the District judge, Raigarh, Maharashtra. They seek the transfer of these proceedings to the Family Court, Patna where a guardianship application filed by the first petitioner in respect of the minor child of their daughter and the respondent is pending. It is the case of the petitioners that it is not possible for them to travel to Raigarh to attend the court proceedings on every occasion due to their advanced age.

( 2 ) THE respondent has been served but has not put in an appearance.

( 3 ) IN the circumstances, we deem it proper to make the petition absolute in terms of prayer (a) and transfer Civil Miscellaneous Application No. 174 of 1997 pending in the Court of the District Judge, Raigarh, Maharashtra to the Family Court, Patna.

( 4 ) ORDER accordingly.

( 5 ) NO order as to costs.
