JUDGMENT
D.K. JAIN, J.—
1.Leave granted.
2.This appeal by the three accused arises out of the order dated 5.3.2007, passed by the High Court of Delhi, dismissing the Criminal Revision Petition No. 92 of 1998 filed by them. In the said petition, a prayer was made by the appellants to quash the charge sheet and the consequential proceedings arising out of First Information Report (F.I.R) No. 155 of 1995, instituted in the court of Metropolitan Magistrate, New Delhi. Appellants No. 1, 2 and 3 are respectively the father-in-law, sister-in-law and the husband of the complainant.
3.A few facts, leading to the present proceedings and necessary to dispose of the appeal are:
“The marriage between the complainant and appellant No. 3 was solemnized at New Delhi on 5.12.1993. After the marriage, the complainant was residing at her matrimonial home in Delhi. It appears that there was some matrimonial discord between the complainant and her husband, appellant No. 3, which resulted in filing of a complaint by the complainant on 17.5.1994 in the Crime against Women (‘CAW’ for short) Cell, Delhi, inter alia, alleging that she was harassed by her husband and in-laws. However, the matter was compromised o
No cases in the provided list are explicitly identified as overruled, reversed, or treated as bad law based on the language and treatment indicators. The list predominantly contains references to cases that have been followed, endorsed, or relied upon, especially the repeated citations of "Onkar Nath Mishra v. State (NCT of Delhi), (2008) 2 SCC 561." There are no clear phrases such as "overruled," "reversed," "criticized," or "abrogated" that would suggest a case has been explicitly overruled or invalidated. Therefore, no case law is conclusively identified as bad law from the information given.
[Followed / Endorsed / Reliance]
The majority of references, especially to "Onkar Nath Mishra v. State (NCT of Delhi), (2008) 2 SCC 561," indicate that subsequent decisions have relied upon or endorsed this case. For example, multiple entries state "the Court endorsed the following view taken in Onkar Nath Mishra" or "reliance is placed on the decision of Apex Court in Onkar Nath Mishra..." This pattern shows consistent judicial treatment of this case as good law or authoritative.
Several entries explicitly mention that courts have "placed reliance" or "endorsed" the view from this case, reflecting its ongoing legal relevance and acceptance.
Cases such as "Debendra Nath Pandhi, (2005) 1 SCC 568," are also repeatedly cited alongside the SCC 561 case, indicating they are treated as relevant precedents rather than bad law.
The references to "relying on earlier decisions including Onkar Nath Mishra" suggest a consistent judicial approach of following or citing this case as a binding or persuasive authority.
[Uncertain / Ambiguous treatment]
Some references mention decisions "in support of the case" or "while considering the nature of evaluation," but do not specify whether these are affirmations or criticisms.
For example, entries like "the Court reiterated that the evaluation of material and documents is crucial" or "the Court relied on its earlier decisions" do not clarify if the treatment is positive or negative.
The absence of explicit negative language indicates that treatment is generally positive or neutral, but the lack of explicit statements means treatment clarity cannot be definitively established in all cases.
Cases where the treatment is unclear or ambiguous include those with generic references such as "reliance is placed upon" or "the Court endorsed the view," without further context. For instance:
Entries that mention "the Court considered" or "the Court reiterated" without indicating whether this was with approval or criticism.
Specific cases like "State of Karnataka v. L." or "Vikram Johar v. State of Uttar Pradesh" are mentioned, but treatment is not explicitly characterized as overruled or criticized.
Overall, treatment appears to be predominantly supportive or affirming, but without explicit language, these are categorized as uncertain.
Based on the detailed analysis, no cases are explicitly identified as overruled or bad law. The dominant pattern is reliance, endorsement, and reiteration of the case law, especially the case of "Onkar Nath Mishra v. State (NCT of Delhi), (2008) 2 SCC 561." Treatment of this case is consistently positive, indicating its standing as good law. Some references are ambiguous and do not clarify whether the treatment is positive or negative, but there is no evidence of any case being overruled or criticized in the provided list.
