Judgement
This was a suit for specific performance of an agreement alleged to have been entered into by the Appellants, to pay the Mirasidars (The holder or possessor of a heritage. As to the nature of the mirasi rights in Madras, see "Replies to seventeen questions proposed by the Government of Fort St. George, relative to the Mirasi right, by F. W. Ellis, Collector of Madras."— A.D. 1818.) of the villages of Perambore and Nadumbarei, compensation for the loss of their mirasi rights in a certain tract of land outside of the walls and fortifications of the Black Town of Madras, which had been taken possession of by the Madras Government for the purpose of forming an esplanade for the military defence of that quarter. The Plaintiff was the executor of one Mangandoo Vencatachella Moodelly, and claimed compensation for certain shares in the mirasi rights, which his testator had purchased from some of the Mirasidars.
The original Bill was filed by Conjeevaram Woodundy Moodelliar, as the executor under the Will of Mangandoo Vencatachella Moodelly, on the equity side of the Supreme Court of Madras, against Charles Gandoin, Elizabeth Willins, Toleainga Moodelly, Curpoora Moodelly, Yelliap
