Judgement

Appeal from a judgment and decree of the Chief Court of Lower Burma (June 14, 1910) reversing a judgment and decree of that Court in its original civil jurisdiction (February 16, 1909), and from an order of the Chief Court (September 2, 1910) rejecting a petition for review.

The suit was instituted by the respondent against the appellant, his eldest daughter, claiming that under Burmese Buddhist law he was solely entitled to the estates of his two younger daughters Mah Nhin Ghine and Mah Nhin Boo, both deceased, and in the alternative for an inquiry as to the share to which he was entitled, and for consequential relief.

The respondent by his first marriage had the three daughters above referred to, the appellant being born about 1865. Their mother died when the appellant was about eight years old, and the respondent married again. The respondent had traded at Rangoon in cocoanuts, and upon his retiring from business his three daughters commenced to trade on their own account. They lived at home with the respondent and his second wife and family until 1899, when they bought a house out of the profits they had made, and subsequently they lived together and apart from their
