Headnote:Constitution of India, Article 21 - Gujarat riots - Special Investigating Team constituted in compliance with orders of court – Appointment of additional members - Necessitated because of the increase in the volume of work – Also in view of the reluctance of Shri C.B. Satpathy to resume his assignment in the investigating team – Additional members appointed - Former Special Director, CBI, New Delhi and former DIG, CBI, New Delhi directed to join – Both shall form part of the Special Investigating Team.
ORDER
1. A letter dated 14-5-2009 received from the Chairman, Special Investigating Team has been placed before us. The Chairman has requested for induction of two more members to the existing investigating team. It is stated in the letter, that the induction of additional members has been necessitated because of the increase in the volume of work in the light of the recent orders of this Court and the reluctance of Shri C.B. Satpathy to resume 9 his assignment in the investigating team.
2. Having heard the learned amicus curiae and the learned counsel for the State of Gujarat, we accede to the prayer made in the letter and direct that S/Shri Paramvir Singh, former Special Director, CEI, New Delhi and A.K. Malhotra, former DIG, CBI, New Delhi shall form part of the Special Investigating Team.
3. In view of what is mentioned by the Chairman, Shri C.B. Satpathy is relieved of his assignment as member of the investigating team.
