Order

1. If certain State Pollution Control Boards have not responded to CPCB, they have done it at their own peril, since this Court has already issued directions to the State Boards to respond to CPCB. CPCB shall file affidavit during the course of the day. On behalf of the petitioner, request is made for grant of time to file rejoinder. Let the same be filed within four weeks.

2. In view of the affidavit filed on behalf of Respondent 4 that as of now, there is no proposal to set up a new export zone at Aligarh by UPSIDC or APEDA and same being also the stand of the Union of India, for the present the cause of action against Respondents 3 and 4 does not survive and, therefore, these two respondents are deleted from the array of parties.

3. The case is adjourned.
