This is an Appeal by the State of South Australia from a judgment of the High Court of Australia, dated the 22nd day of May, 1911, in proceedings instituted by the State of South Australia against the State of Victoria substantially for the purpose of settling a disputed boundary between the two States. The portion of the boundary between the two States which is in question stretches northward from the coast to the Murray River.
The judgment of the majority of the High Court was in favour of the defendants, the State of Victoria, and accordingly on the 22nd day of May, 1911, the action was dismissed, and it is from this decision of the High Court that the present Appeal is brought.
In the course of the proceedings before the High Court the history of the question of the boundary between South Australia and Victoria was minutely examined both in respect of law and of fact, and all relevant documentary and oral evidence was adduced and is now to be found in the record and their Lordships feel that all the material that could be serviceable for deciding the question in dispute has been laid before them, and that in the argument of the Appeal the legal effect of the variou
