ORDER :

K.G. Balakrishnan, J.

This appeal is preferred against the judgment of the High Court of Karnataka. The appellant was charged for the offence under Sections 306 and 498-A Indian Penal Code. The Sessions Court found him guilty of the offences under Sections 306 and 498-A Indian Penal Code and he was sentenced to undergo imprisonment for a period of 5 years and 3 years respectively. The High Court confirmed the conviction and sentence passed by the Sessions Court. It is against the same, the present appeal was preferred.

2. Brief facts are as follows:

    The appellant was married to the deceased Kanthi @ Revathi and they had a daughter. The marriage was celebrated on 1-6-1983. The marital life continued happily for some period, and thereafter it ran into rough weather. It was alleged that the appellant had an affair with one Ammu, PW 16. The prosecution case is that on 29-8-1985 at about 1.30 p.m. the deceased Revathi was working in the field along with one other person. The prosecution alleged that at about 1.30 p.m. she jumped into the tank situated in the paddy field. PW 13 who was passing nearby, saw the deceased Revathi drowning but he could not rescue her.
