Headnote:

Compliance - States' Affidavits - Court directs compliance with previous order

Fact of the Case:

The court received affidavits from several states and union territories regarding compliance with a previous order. Some states fully complied, some partially complied, and some did not comply at all.

Finding of the Court:

The court directed states to ensure compliance with the previous order and file affidavits of compliance within specified timelines, warning of potential contempt proceedings for defaulting states.

ORDER :

In pursuance of the order dated 3.12.2013, nine States and two Union Territories have filed their affidavits. It transpires therefrom that States of Tripura, Bihar, West Bengal, Odisha and Sikkim have fully complied with the directions in the order dated 3.12.2013. The two Union Territories namely; Andman & Nicobar and Chandigarh have also complied with the directions.

2. We are informed that though States of Haryana, Jharkhand, Goa, Gujarat, Tamil Nadu, Madhya Pradesh, Punjab and Jammu & Kashmir have not filed their affidavits of compliance but these States have also complied with the order dated 3.12.2013. Advocates-on-record of these States shall ensure that the affidavit of compliance by the respective State is filed within eight weeks from today.

As regards States of Andhra Pradesh, Uttrakhand, Karnataka, Kerala, Puducherry, Maharashtra, Chattisgarh, Rajasthan, Assam, Arunachal Pradesh, Mizoram, Uttar Pradesh, Himachal Pradesh, Manipur, it appears that these States have either not complied with or partially complied with the order dated 3.12.2013. The Chief Secretaries of these States are directed to ensure that compliance of the order dated 3.12.2013 is positively made within ten weeks from today and affidavit of compliance is filed in this Court on or before 15.7.2014 failing which the Court may have to initiate contempt proceedings against the defaulting States.

4. List the matter on 5.8.2014.
