Rajinder Singh – Appellant
Versus
Mangal Singh – Respondent


JUDGMENT :

1. The matter was heard for considerable length of time on the last occasion. Today after the matter was called out, at the suggestion of the court the parties were in a mood to agree that the criminal complaint should not be proceeded with any further. We accordingly-allow the appeal, set aside the High Court's Order and restore the orders of the trial court and the first appellate court.

2. The appellant will pay to the respondent No. 1 a sum of Rs. 2000/- out of which it is recorded that a sum of Rs. 500/- is paid to-day to the respondent's counsel. The balance will be deposited by appellant in this court within six months from today; an intimation of such diposit shall be given to the counsel for the respondent No. I and the latter shall be at liberty to withdraw the same. Compliance of this order be reported to the court.

3. Parties undertake that no further action or proceedings either civil or criminal will be resorted to by one against the other.
