ORDER :
1. Heard Mr. Subramonium Prasad, learned senior counsel for the petitioners, Ms. Hemantika Wahi, learned counsel for the State of Gujarat and Mr. Gaurav Sharma, learned counsel for the Medical Council of India.
2. Having heard learned counsel for the parties and keeping in view the Regulation 9(vii) of the Medical Council of India Postgraduate Medical Education Regulations, 2000, we direct that the State of Gujarat shall conduct the counseling keeping in view the said Regulation which provides for 50% of the seats to be reserved in the Post Graduate Diploma courses for Medical Officers in the Government service, who have served for at least three years in remote and/or difficult areas. The counseling shall be done keeping in mind the 50% of the reserved seats as mentioned herein-above. Needless to say, the selected candidates shall abide by all the other conditions that are postulated in the Regulations of the Medical Council of India or in the Regulations of the State. If no notification has been issued by the State Government with regard to remote and/or difficult areas, the same shall be issued forthwith as that is the mandate of the Regulations.
