3. Heard learned counsel for the parties.
4. This appeal takes exception to the judgment and order dated 06.02.2019 passed by the High Court of Judicature at Allahabad in Crl. Misc. III Bail Application No. 142906 of 2016 in Criminal Appeal No. 2960 of 2011, whereby the High Court rejected the bail application filed by the appellant in connection with FIR No. 867 of 2009 registered at PS-Hapur Nagar, District-Ghaziabad, Uttar Pradesh for the offence punishable under Sections 147, 148, 149, 302, 506 and 34 of Indian Penal Code.
5. Taking overall view of the matter and considering the fact that the criminal appeal pending before the High Court may not be taken up for hearing in the immediate near future, whereas the appellant has already undergone more than 11 years in jail so far and the fact that his conduct in jail has been satisfactory, we direct that, during the pendency of criminal appeal before the High Court, the appellant (Aslam) be released on bail to the satisfaction of the Trial Court in connection with FIR No. 867 of 2009 registered at PS-Hapur Nagar, District-Ghaziabad, Uttar Pradesh and on such terms and conditions as may be i
