( 1 ) THIS writ petition is referred to Division Bench by our learned brother, M. N. Rao, J. noticing that when he gave judgment on 30-1-89 in W. P. No. 16250/88. holding that any vacancy in the post-graduate courses of medicine arising after the prescribed date cannot be filled, the judgment of K. Ramaswamy, J (as he then was) dated 3-9-1986 in W. P. No. 7557/86 holding that the said rule is only directory but not mandatory, was not brought to his notice.

( 2 ) THE petitioner applied for admission to post graduate medical courses. The subjects of her choice in order of preference are (1)M. D. Gynaecology, (2) Diploma in Gynaecology (3) Diploma in ophthalmology. By the time of her turn, the first two of the above mentioned subjects were opted by the students who secured higher marks, so she could get a seat only in the Diploma in Ophthalmology. The second of the above mentioned courses viz. , Diploma in Gynaecology and Obstetrics was opted by Dr. Chandra Sekbar who obtained higher rank than the petitioner. But he vacated the seat having obtained admission in Bangalore college. The petitioner then applied to the respondents tor allotting the said seat
