( 1 ) THE point that arises in this writ petition is of considerable importance in the context of admissions to M B B S courses as also Engineering Courses in the state of Andhra Pradesh. The relevant rule 8-E (4) shows that apart from other things, a person can be treated as an Ex-Serviceman if he "has been released at his own request, after completing five years service in the Armed Forces of the Indian union . The learned counsel for the petitioner Sri C P Sarathy has relied upon a decision of a Division bench in Writ Appeal No. 825 of 1982 dated 18-11-83, wherein Rule 2 (e) of the Rules for Admission to I Year MBBS course in Medical Colleges in Andhra pradesh State made in G O Ms. No. 490, m and H, dated 21-6-82 was held to be discriminatory. The learned Judges therein were up holding the judgment of a learned single Judge of this Court.
