( 1 ) THE point that arises in this writ petition is of considerable importance in the context of admissions to M B B S courses as also Engineering Courses in the state of Andhra Pradesh. The relevant rule 8-E (4) shows that apart from other things, a person can be treated as an Ex-Serviceman if he "has been released at his own request, after completing five years service in the Armed Forces of the Indian union . The learned counsel for the petitioner Sri C P Sarathy has relied upon a decision of a Division bench in Writ Appeal No. 825 of 1982 dated 18-11-83, wherein Rule 2 (e) of the Rules for Admission to I Year MBBS course in Medical Colleges in Andhra pradesh State made in G O Ms. No. 490, m and H, dated 21-6-82 was held to be discriminatory. The learned Judges therein were up holding the judgment of a learned single Judge of this Court. I have perused the judgment of the Division Bench as well as the judgment of the learned single Judge which was given in WP Nos. 5031 and 4938 of 1982 and batch dated 20-8-82. 2 I am of the view that the question whether an Ex-Serviceman, for purposes of admission of his child, should have put in five years service in the Army or not, is a matt
