( 1 ) THESE three writ appeals are connected and can be disposed of together.

( 2 ) WRIT Appeal No 371/1990 is filed by the Excise Superintendent, nellore and two others who were respondents 1 to 3 in WP No 19130/1988, Writ appeal No 343/1990 is preferred by Sri y Harnath Reddy who is the 5th respondent in WP No 12975 of 1989. Writ Appeal no 401/1990 is filed by the Collector of excise, Excise Superintendent and the commissioner of Excise who are respondents 1, 2 and 4 in the same WP No 1297s/ 1989.

( 3 ) WRIT Petition NJ 19130/1988 was fild by M Ramanaiah and 15 others who are members of the Nellore Toddy tappers Co-operative Society (hereinafter called the Society) for the iisus of a writ declaring the action of the Excise authoties in canceling the licence of the society by orders dated 1-12-1988 as illegal and for holding that the auction held on 14-12-1988 in favour of respondents 4 to 6 therein (respondents 17 to 19 in writ appeal No 371/1990) as illegal and arbitrary.
