( 1 ) THIS petition for a writ of habeas corpus directing the five respondents to release the 32 Youth Congress (1) activists, whose names are shown in Annexure-A ; or to declare the detention pursuant to the resolution of the andhra Pradesh State Assembly dated 28-3-1989 to be illegal is filed by president of the Youth Congress (I) Wing of the Andhra Pradesh State. 1st respondent is the Speaker of the Andhra Pradesh State Legislative Assembly 2nd respondent is the Chief Minister of the State ; 3rd respondent is the secretary of the Andhra Pradesh State Legislative Assembly ; 4th respondent is tbe Superintendent of Jail, where the detenus arc confined ; and the 5th respondent is the Circle Inspector of Police, Asifnagar.
( 2 ) THE Office had raised an objection about the maintainability of the writ petition and when it came up before the Court on 5-4-1989, after hearing the counsel for the petitioner and for the reasons mentioned in the order, notice was directed only to respondents 3 and 4 to show cause why tbe writ petition should not be admitted returnable by the next working day i. e. 7-4-1989.
