( 1 ) THE twin questions canvassed in this group of Writ Petitions are:- (1) GO Ms. No. 120. Food and Agriculture (CS II) Department dated 27-2-88 amending the Andhra Pradesh Scheduled commodities (Regulation of Distribution by Card System) Order, 1973, for short, scheduled Commodities Order is ultravires and beyond the powers of the State government. (2) Clause 17 of the Scheduled commodities Order as amended by GO Ms. No. 120, Food and Agriculture (CS II) department dated 27-2-1988 conferring appellate powers on Ministers is arbitrary and unreasonable.

( 2 ) THE Scheduled Commodities order was issued in GO Ms No. 1088, f and A (CS. V) Department, dated 28-9-73. The Order provides for regulation and distribution of essential commodities by authorised agents through Fair Price Shops to the Card Holders. Under Clause 3 of the original Order, the power to issue authorisation was conferred on the Assistant Supply Officer in the case of hydrabad District and Revenue Divisional Officers in regard to other Districts. Appeals were provided under Clause 17 to the Chief rationing Officer in regard to Hyderabad district and District Collector in the case of other districts. Th
