( 1 ) THE Petitioner and three others submitted tenders tor transportation of essential commodities from the godowns of the Food Corporation of india to Mandal Stockist point known as stage No. 1, in Warangal district, for the year 1989-90, i. e. ; from 1-4-1989 to 31-3-1990. The last date for the submission of tenders was 4-3-1989. As per condition 4 of the tender conditions, every tender should be accompanied by an account payee bank draft for Rs. 50,000/- drawn in favour of the Vice-Chairman and Managing director of the first respondent-Corporation the Andhra Pradesh State Essential commodities Corporation Ltd. (hereinafter referred to as the Corporation ). Condition 15 lays down that the decision of the Vice-Chairman and managing Director in the finalisation of the tenders is final and binding on the tenderers. Condition No, 20 says that the tenders should be strictly in conformity with the prescribed terms and conditions and tenders which deviate from the terms and conditions are liable to be ignored and rejected. The petitioner was the contractor for the previous year and a sum of Rs. 1,39,860, according to him, was due and payable by the corporation in respect
