( 1 ) THIS revision petition is directed against the order dt. 2. 3. 1985 passed in i. A. No. 43 of 1985 in O. S. No. 426 of 1984 on the file of the Subordinate Judge, rangareddy District at Saroornagar. The plaintiff in the suit viz. State Bank of India hal is the petitioner herein and the respondent No. 1 is the defendant, who has taken a loan of a sum of Rs. 1,64,613-42p. from the petitioner bank. The respondent No. 2 is the State Bank of Hyderabad, sanathagar branch with whom Respondent No. 1 has opened an account allegedly in contravention of the terms and conditions of the loan.
( 2 ) THE petitioner filed an application I. A. No. 43 of 1984 in O. S. No. 426 of 1984 under Order 38 Rule 5 read with order 21, Rule 46 and section 151 of the code of Civil Procedure for issuing an order of attachment before judgment by a prohibitory order to the guarnishee-3rd party viz. the Manager, State Bank of hyderabad, who is the Respondent No. 2 herein. The contention of the petitioner is that a suit has been filed for the recovery of the amount of loan due from the Respondent No. 1 together with future interest and costs.
