( 1 ) THE Nellore District Co-operative Marketing Society Ltd. represented by its Business Manager has filed this application under Article 226 of the Constitution of India seeking a writ of certiorari or any other appropriate writ, order or direction to quash the order made by the Co-operative Tribunal (Prl. District Munsif, Nellore) in I. A. N. 859/76 in A. P. P. No. 2/74, dated 3-3-198 confirming the order of the Deputy Registrar of Co-operative Societies, nellore, dated 24-7-74 (mistake for 27-7-74) dismissing for default the claim of the aforesaid Marketing Society for Rs. 9,538-00 against one Chennareddy kodandarami Reddi.

( 2 ) THE Nellore District Co-operative Marketing Society (hereinafter referred to as the Petitioner) filed an application A. Re. No. 44/70-71 before the Deputy Registrar of Co operative Societies against one Ch. Kodandafamireddy claiming a sum of Rs. 9,538/- alleging shor-delivery of rice, broken flee and gunnies entrusted to him for the period 5-12-65 to 4-4-66. The claim was based on an alleged agreement dated 5-5-1975. Shri Ch. Kodandaramireddy was alleged to be a member of the petitioner-Society and Proprietor of Sri kodandarama Rice Mill
