( 1 ) THE revisionist a private limited company known as Challapalli sugars Limited, Challapalli, Divi Tq. Krishna Dist, filed a declaration under sec. 8 (1) of the A. P. Land Reforms (Ceiling on Agricultural Holdings) Act, 1973 (herein after referred to as the act ) on 11-4-1975. The declaration was duly published calling for objections. It was also verified by the special Dy. Tahsildar and his report was supplied to the declarant. The declarant did not file any objections to the verification report, instead filed W. P. No, 2180/76 in the High Court of Madras and obtained stay of all proceedings. Two share-holders of the Sugar Factory filed OS. 7225/76 on the file of the IV city Civil Court, Madras and obtained an interim injunction on 10-9-76 restraining the State of A. P. from enforcing the provisions of the Act, pending disposal of the suit. The writ petition referred to, was dismissed by the Madras High court on 4-12-1981. However, the high Court granted time for moving the supreme Court for obtaining appropriate orders till 15-1-1982. But no orders were obtained from the Supreme Court. However, the interim injunction granted in the suit was made absolute
