PUNNAYYA, J.

( 1 ) THIS appeal is directed against the compensation granted by the the learned Third Additional Judge, City Civil Court, Hyderabad in O,p. No. 135 of 1971. The appellant is the Andhra Pradesh Agricultural University for whose benefit the land in question was acquired.

( 2 ) AS the appellant was not a party in the Original Petition, Sri A. Anantha Reddy, the learned counsel for the respondents, contends that the appeal is not maintainable.

( 3 ) IN support of his contention, Sri A. Anantha Reddy relies upon the decision of the Full Bench of this Court in A. P. Agri. University Vs. Mahamoodunisa begum.

( 4 ) SRI B. Siva Reddy, the learned Standing Counsel for the Agricultural University, on the other hand relies upon the decision of the Supreme court in Himalaya Tiles Marble (P) Limited Vs. F. V. Coutinho and contends that the Supreme Court pronounced authoritatively that the beneficiary for whose benefit the lands are acquired is a person interested as per the definition of Section 18 of the Land Acquisition Act and as such, the appellant is entitled to prefer the appeal and the appeal is, therefore, maintainable. In view of the aforesaid decision of the Supreme Court
