( 1 ) THE plaintiff Messrs. Lakshmi Finance Corporation which is a firm, is the plaintiff. The plaintiff filed the suit O. S. No. 128/1976 on the file of the District Judge, Nellore, against the defendant N. S. Pantulu, for recovery of Rs. 12,850/- which is made up of (1) Rs. 4,350/- representing the principal and interest due on a promissory note Ex. A-1 dated 3-3-1972 executed by the defendant in favour of the plaintiff for Rs. 3000/- agreeing to repay the same with interest at 0-75 ps. per day per Rs. 1000/- and (2) Rs 8,500/- being the principal and interest due on a promissory note Ex. A-4 dated 23-5-1972 executed by the defendant in favour of the plaintiff for rs. 6000/- agreeing to repay the same with interest at 15% per annum and the defendant deposited title deeds with the plaintiff. It is alleged that the promissory note Ex. A-1 was fully supported by consideration and the defendant deposited with the plaintiff his title-deeds Ex. A-2 dated 14-5-1940 and Ex. A-12 dated 2-8-1922 in respect of his house property, with a view to create a mortgage for payment of the amount due under the promissory note Fx-A-1 and also for amounts to be borrowed in future
