Versus
Sub-Collector Ongole Prakasam District – Respondent


LAKSHMAIAH, J.

( 1 ) THIS is an application filed under Article 226 of the Constitution of India for the issuance of a writ of certiorari seeking the quashing of the order of the Sub-Collector, Ongole, Prakasam District, 1st respondent herein dated 21-11-1975 terminating the services of the petitioner as a village munsif by giving him one months notice.

( 2 ) THE permanent village munsif of Parala Chirala Taluk, Prakasam district, one by name Sri G. Swamulu was suspended in the year 1972. In that vacancy the petitioner was appointed temporarily for a period of six months from the date of the appointment on 10-4-1973 by the Revenu divisional Officer, Ongole. Subssquently Sri G. Swamulu died on 3-9-1974 even subsequent to the expiration of the period of six months the petitioner had been continued as the village munsif.

( 3 ) THE Sub-Collector, 1st respondent herein, on 27-9-1974 ratified the action of the Tahsildar in continuing the service of the petitioner as acting village munsif beyond 10-10-1973 till the post is filled up permanently on regular basis.

( 4 ) THE Tahsildar, Chirala, 2nd respondent herein, made a publication on 27-9-1974 inviting applications from suitable and qual
