( 1 ) AS a common question of law arises in the Writ Appeal and the Writ Petition, they are disposed of by a common Judgment.

( 2 ) THE Writ appeal is preferred against the judgment of our learned brother Chinnappa Reddy, J. in W. P. No. 1955/1977. In that writ petition the term of the elected members of the Managing Committee of the Large Scale Co-operative Society, Bhongir, expired in 1972 and thereafter the petitioners therein were appointed as persons in-charge to manage the affairs of the Society under the provisions of Section 32 (7) (a) of the Andhra Pradesh Co-operative Societies act (hereinafter called the Act), initially for a period of six months, and subsequently their term of office was extended from time to time; the last of the extension was made on 31-12-1976, and the term expired by 30-6-1977. When the term was about to expire, the deputy Registrar of Co-operative Societies, Bhongir, purporting to act under Section 32 (7) (a) of the Act, appointed the Taluk Cooperative officer, Bhongir to be the sole person to manage the affiairs of the society from 1-7-1977 to 31-8-1977.
