( 1 ) THIS miscellaneous petition has been filed under the following unusual circumstances. Criminal Appeal No. 194 of 1976 is an appeal against acquittal in Sessions case No. 12 of 1975 on the file of the learned Sessions Judge, nalgonda. According to the petitioner in this miscellaneous petition, a proposal of the Superintendant of Police. Nalgonda to prefer an appeal to this court against the said order of acquittal was recieved in the office of the Public Prosecutor, High Court on December 24, 1975. The last date for filing appeal was February 12, 1976. The Additional public Prosecutor, High Court of andhra Pradesh, Hyderabad gave opinion on January, 3, 1976 that appeal should be filed, and Government orders were awaited. The appeal was presented to this Court on January, 29, 1976 till that date Government orders were not recieved. Normally, there will be delay in receiving Government orders and appeals are presented so as to save the bar of limitation. In this case, also the appeal was presented on January, 29, 1976 and it appears that this was done in anticipation of the Government orders to file the appeal.
