Headnote:
LANDLORD AND TENANT - EVICTION - SECTION 11 OF THE ANDHRA PRADESH BUILDINGS (LEASE, RENT AND EVICTION) CONTROL ACT, 1960 - APPELLATE AUTHORITY CAN RELY ON THE FINDING OF THE RENT CONTROLLER THAT THE RELATIONSHIP OF LANDLORD AND TENANT EXISTS FOR PASSING AN ORDER UNDER SECTION 11 - FULL BENCH DECISION IN CHAGANLAL V. NARSINGH PERSHAD (1972 (2) AN. W. R. 156) CLARIFIED.
Fact of the Case:
The petitioner, a tenant, challenged the order of the appellate authority directing him to deposit arrears of rent under Section 11 of the Andhra Pradesh Buildings (Lease, Rent and Eviction) Control Act, 1960. The appellate authority had relied on the finding of the Rent Controller that the petitioner was a tenant and had failed to pay rent, to pass the order under Section 11.
Finding of the Court:
The court held that the appellate authority could rely on the finding of the Rent Controller that the relationship of landlord and tenant existed for passing an order under Section 11. The court clarified that the Full Bench decision in Chaganlal v. Narsingh Pershad did not require another full-fledged enquiry into the jurisdictional fact of the relationship of landlord and tenant at the appellate stage.
Issues: Whether the appellate authority can rely on the finding of the Rent Controller that the relationship of landlord and tenant exists for passing an order under Section 11 of the Andhra Pradesh Buildings (Lease, Rent and Eviction) Control Act, 1960.
Ratio Decidendi: The court held that the appellate authority could rely on the finding of the Rent Controller that the relationship of landlord and tenant existed for passing an order under Section 11. The court reasoned that the plain language of Section 11 precluded the tenant from contesting the application for eviction or preferring an appeal unless he paid or deposited the arrears of rent. The court also noted that the appellate authority would be in a better position to decide the appeal since the Rent Controller had already found that the jural relationship existed.
Final Decision: The court allowed the revision petition, set aside the order of dismissal of the appeal, and gave the tenant 15 days to deposit the amount as per the direction of the appellate authority. If the tenant deposited the amount, his appeal would be heard and disposed of in accordance with law. If he failed to deposit the amount, the appellate authority could pass an appropriate order under Section 11.
