District Collector, (Panchayat Wing) East Godavari – Respondent
( 1 ) KESANAKURRU Gram Panrhayat in the East Godavari District originally consisted of the village and also its hamlet Kesanakarrupalem end eleven other hamlets. By his order dated 23-1-1970 the district Collector, Panchayat Wing, East Godavari, who is the first respondent bifurcated the village and constituted a new Gram Pancbayat called Kesankarru Palem and also appointed a special Officer for the newly constituted panchayati This writ is filed to quash the said order.
( 2 ) WHAT had happened before the order in question was passed may be briefly stated. On the ground that certain irregularities were committed by the Panchayat, the 1st respondent dissolved it by bis proceedings dated 22-7-1969. The present petitioner filed writ petition No. 2799 of 1969 in this court questioning the legality of that order. That writ petition was disposed of on 3rd October, 1969 holding that the dissolution was valid. It was further held that as a result of dissolution all the vacancies should be deemed to be casual vacancies and elections should be held to fill up those vacancies within four months.
