( 1 ) THIS appeal by the employer is directed against the order of the industrial Tribunal, Andhra Pradesh and Judge Employees Insurance Court, in employee s Insurance Case No. 3 of 1963 allowing the application of the respondent- corporation under section 66 of the Employee s State Insurance Act, 1948. The brief, material and relevant facts that led to this appeal are r. s follows :- one Abdul Rehman, a young unmarried employee of the appellant M/s. Hyderabad asbestos Cement Products Limited, Sanathnagar, Hyderabad, while picking waste from a rolling cement sheet called felt in the course of the discharge of his duty as a picker, has met with an accident, whereby his hand was caught in the drums and was crushed, as a result of which he died instantaneously on 29th May, 1961. The deceased employee along with another was picking waste from a rolling cement sheet standing on a platform situated 2 1/2 feet above the ground level and from a distance of 8 feet from the felt. The felt moves and passes through a drum, a heavy roller, and if any foreign substance comes and falls in the drum while the felt is passing beneath the drum, it will jump aboutfour inches.
