( 1 ) THESE two appeals have been filed against a common judgment and order passed in E. P. No. 99 of 1955 and E. A. No. 203 of 1955 in O. S. No. 56 of 1948 on the file of the Subordinate Judge, Chittoor. The appellants in both the appeals were the petitioners in E. A. No. 203 of 1955, respondents 1 to 7 in E. P. No. 99 of 1955 and defendants 1, 2, 3, 4, 6 and 7 in O. S. No. 56 of 1948. The respondents herein were petitioners 1, 2, 3, to 6 in E. P. No. 99 of 1955, respondents 1 to 6 in E. A. No. 203 of 1955 and the plaintiffs in O. S. No. 56 of 1948. For the sake of convenience and brevity, the respondents are hereafter called the decree- holders and the appellants the judgment-debtors.
( 2 ) THE relevant facts of the case may be briefly stated :- the decree-holders filed E. P. No. 99 of 1955, an application for execution of the decree in O. S. No. 56 of 1948 by delivering the properties decreed. E. A. No. 203 of 1955 is an application by the judgment-debtors for reviewing and setting aside the order passed by the Sub-Court, Vijayawada, in E. A. No. 144 of 1955. O. S. No. 56 of 1948 is a suit for partition which was ultimately compromised and on 19th March,
