( 1 ) THIS revision petition is directed against the Order of the District judge, Chittoor, in a Civil Miscellaneous Appeal preferred before him against the order of the District Munsif, Kuppam, dismissing the application for restoration of the suit on the ground that there was no sufficient cause. The sole point for determination in this revision petition is as to whether the courts below were justified in dismissing the application for restoration. The brief facts relating to the case are that the plaintiff-petitioner who is a minor, filed a suit by his next friend, being O. S. No. 64 of 1952 in the Court of the District Munsif, kuppam, for the recovery of his half share as one of the reversioners entitled to the same. This suit was filed as against other reversioner, who was made respondent No. 2, and it was stated that he was entitled to the other half. During the pendency of the suit the plaintiff filed a petition for amendment of the plaint by reason of the subsequent events that took place after the institution of the suit. This, application for amendment of the plaint was allowed by the trial Court and the matter was taken up by way of revision before the High Court of Madr
