Headnote:Jurisdiction of Civil Court - when a suit is maintainable.
So long there is Jurisdiction with the authority to pass orders under an Act and the particular Act also provides machinery for appeal or revision. The party can proceed only under the Act, However wrong the order may be it can be proceeded only under the Act In such circumstances it is not lack of Jurisdiction but only improper assessment and the civil court has no jurisdiction to entertain a Suit (paras 8 and 9).
