Headnote:Motor Vehicles Act - vicarious liability of the owner for the negligence of a driver who was not its servant.

       HELD: The owner of a jeep cannot be held liable for the negligence of the driver who was not a servant of the owner. The State Government who was the master of the driver was not made a party to the proceedings. The principle of respondent superior or vicarious liability can be applied to a vehicle owner-where the negligence is that of the owners servant or the servant of the owners agent.
